TERMS AND CONDITIONS: AGREEMENT OVERVIEW & TERMS - PRIVACY POLICY - CODE OF CONDUCT - RETURN POLICY
AGREEMENT OVERVIEW
By purchasing a ticket to this Workshop or Class, the attendee acknowledges and agrees to the following terms and conditions regarding refunds, rescheduling, and participation. This agreement constitutes a binding policy between the attendee (“Student”) and Heather Broomhall LLC, operated by Heather Broomhall.
AGREEMENT TERMS
1. Indemnification
The Participant agrees to indemnify, defend, and hold harmless Heather Broomhall LLC, Heather Broomhall, and any associated instructors, assistants, contractors, or venue providers also known as affiliates, from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from participation in The Beauty Workshop, including but not limited to personal injury, property damage, or alleged negligence.
2. Assumption of Risk & Liability Waiver
The Participant acknowledges that participation in this workshop involves the use of cosmetics, skincare products, and other materials that may cause allergic reactions or irritation. By attending, the Participant assumes full responsibility for any injury, reaction, or loss that may occur during or after the event. The Participant releases and discharges Heather Broomhall LLC, Heather Broomhall Photography LLC, Heather Broomhall, and associated parties from all liability related to such risks, except in cases of gross negligence or willful misconduct.
3. Accidents and Medical Emergencies
In the event of illness, accident, or medical emergency during the workshop, the Participant authorizes Heather Broomhall LLC and/or its representatives to seek medical attention as deemed necessary. The Participant understands that they are solely responsible for any related medical expenses incurred.
4. Mediation & Dispute Resolution
In the event of any dispute arising out of or relating to this agreement, both parties agree to attempt to resolve the matter through good-faith negotiation. If such negotiations fail, the dispute shall be submitted to mediation before any legal action is initiated. The mediation shall take place in Tulsa, Oklahoma, and each party shall bear its own costs unless otherwise agreed.
5. Class Action Waiver
The Participant agrees that any claim or dispute shall be brought on an individual basis and not as part of a class, collective, or representative action. The Participant expressly waives any right to participate in a class action or similar proceeding against Heather Broomhall LLC.
6. Copyright & Intellectual Property
All workshop materials, images, handouts, and content provided by Heather Broomhall LLC or the instructor remain the intellectual property of their respective creators and are protected under copyright law. These materials may not be reproduced, distributed, or used for commercial purposes without written consent.
7. Model Release
By attending this workshop, the Participant grants Heather Broomhall LLC, Heather Broomhall Photography LLC, and/or it's affiliates, including but not limited to Heather Broomhall, permission to photograph, record, and use their image, likeness, or voice in promotional materials, social media, or advertising related to the event. If the Participant wishes to opt out, they must notify the organizers in writing prior to the start of the workshop.
8. Acknowledgment and Binding Effect
By completing registration and payment for this workshop, the Participant affirms that they have read, understood, and agreed to all terms and conditions set forth herein. This agreement shall be binding upon the Participant and their heirs, legal representatives, and assigns.

REFUND POLICY
Due to the nature of digital products, refunds are not allowed FOR DIGITAL PRODUCTS.
In short: Workshops, events, classes, are non-refundable but are transferrable. You agree that your transferable ticket will not be sold by you or anyone working on your behalf for more than the total cost of the workshop, class, or event.
1. All ticket/seat purchases are non-refundable.
Once your registration and payment are complete, your seat in the workshop is reserved exclusively for you. Due to limited class size and pre-purchased materials, no refunds will be issued for any reason other than those explicitly outlined in this policy.
2. Ticket Transfers
If you are unable to attend, your ticket may be transferred to another person.
The transfer must be made at least 48 hours before the scheduled start of the workshop.
Transfers are valid only for the full amount of the original payment and cannot be resold for profit.
The original purchaser must notify Heather Broomhall LLC in writing (via email to [email protected]) of the transfer, including the new attendee’s full name and contact information.
3. Instructor Illness or Emergency
In the rare event that an instructor (either the Makeup Artist or the Photographer/Host) becomes ill or experiences an emergency that prevents their participation:
The workshop will not be cancelled, but rescheduled to a new date within a reasonable timeframe.
All registered participants will be notified promptly by email and/or phone using the contact information provided at registration.
All previously purchased tickets will automatically transfer to the rescheduled date.
If a participant is unable to attend the rescheduled date, a refund will be issued and limited to the full purchase amount for the workshop/class. Refunds will not exceed the total amount of the participant’s original payment.
4. Cancellations Due to Circumstances Beyond Control
In the event of severe weather, venue issues, or other unforeseen circumstances beyond our control that make it unsafe or impossible to host the workshop, the event will be rescheduled rather than cancelled.
All participants will be notified immediately via email and/or phone with updated details. If the participant cannot attend the new date, the same refund terms as above apply (limited to the amount originally paid).
5. Force Majeure
Neither Heather Broomhall LLC, Heather Broomhall, LaTavia Ross, nor any affiliate or 3rd party vendor, shall be held liable or deemed in default for any delay or failure in performance resulting directly or indirectly from causes beyond their reasonable control.
These causes include, but are not limited to:

Natural disasters (e.g., fire, flood, storm, tornado, earthquake)
War, terrorism, or civil unrest
Government restrictions or mandates
Epidemics, pandemics, or public health emergencies
Power outages, transportation failures, or venue inaccessibility
In such cases, the workshop will be rescheduled to a later date. If a participant cannot attend the rescheduled event, they may request a refund limited to the original amount paid for the workshop. No further damages, costs, or consequential claims shall be owed by the organizers.
